Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Moonvert ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

Moonvert is developed and operated by Andrii Kyrychenko and Oskar Vereš, operating under the trade name "Kavo Studio" ("we", "us", or "our"). Kavo Studio is a trade name and not a registered legal entity.

2. Description of Service

Moonvert is a desktop application for macOS that enables local file conversion between various formats, including images, documents, and geospatial data. All processing occurs locally on your device.

3. License

We grant you a non-exclusive, non-transferable license to use Moonvert on your personal devices for personal and commercial use.

Moonvert is also available as open-source software. You may build and use the Application from source code according to the terms of the applicable open-source license. Building from source does not include automatic updates or priority support.

4. Restrictions

You agree not to:

• Redistribute, sell, or sublicense the compiled Application without authorization
• Use the Application for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the Application (except as permitted by applicable law or the open-source license)
• Remove or alter any proprietary notices, labels, or marks on the Application

5. Intellectual Property

The Application, including its code, design, graphics, and documentation, is protected by copyright and other intellectual property laws. Andrii Kyrychenko and Oskar Vereš, operating as Kavo Studio, retain all rights not expressly granted in these Terms.

6. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee the accuracy or reliability of file conversions. You are responsible for verifying the output of any conversion before use.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANDRII KYRYCHENKO AND OSKAR VEREŠ (OPERATING AS KAVO STUDIO) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.

Our total liability for any claims arising from these Terms or your use of the Application shall not exceed the amount you paid for the Application in the twelve (12) months preceding the claim.

8. Payments

All payments are processed through LemonSqueezy. By making a purchase, you agree to LemonSqueezy's terms of service. All sales are final, and refunds are provided at our sole discretion.

9. Updates

We may release updates to the Application from time to time. While the paid license includes automatic updates, we do not guarantee that updates will be available or that they will be compatible with your system.

10. Termination

We may terminate or suspend your access to the Application at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of the Application after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions.
